About the subject
The course provides students with a comprehensive overview of the legal protection of intellectual property in the digital environment with an emphasis on current issues in the information society. Through the analysis of decisions, presentations and solving model cases, it connects theoretical knowledge with its practical application in the field of copyright and industrial property law in the information society.
Target group
Bachelor's and Master's degree students in computer science, applied computer science and law programs (Ib, PLB4d, AIb, PB3d).
Learning Objectives
The aim of the education is to provide students with practical information in the field of intellectual property protection in the digital space. In addition to the basic legislative framework for intellectual property protection resulting from the construction of a single digital market, students are confronted with current case law and practical examples. The course analyzes fundamental decisions in the field of intellectual property, which are discussed in the context of the current development of the information society and the digital environment. The presentation of the chosen topic and the solution of model cases from the field of copyright and industrial property rights effectively combine theory with practice.
Brief course outline
- Intellectual property law in the digital environment. The system of intellectual property law. Legal regulation, liability relations on the Internet, strategy for the protection of intellectual property in the single digital market.
- Copyright and information technologies. Creation and use of copyright works on the Internet. Legal protection of databases, computer programs. Computer piracy, computer crime. Legal aspects of websites and hyperlinks. Exceptions and limitations of copyright in the single digital market.
- Contractual obligations in cyberspace with special regard to intellectual property objects. Public licenses in copyright law.
- Rights of performers, producers of phonograms, producers of audiovisual recordings and radio and television broadcasters in the digital environment.
- Industrial property law and information technologies. Patents, designs, trademarks, trade names, domain names. Domain name registration system. Domain name disputes. Cybersquatting.
- Enforceability of intellectual property rights on the Internet. Application of the territoriality principle and resolution of issues of establishing jurisdiction in intellectual property disputes arising from contractual and non-contractual obligations on the Internet. Judicial and extrajudicial protection of intellectual property, alternative resolution of domain disputes.
- Intellectual property law, protection of personal data. Fundamental rights and freedoms and protection of intellectual property. Protection of privacy on the Internet and DRM. Conflicting aspects of the right to protection of personal data, freedom of enterprise, freedom of expression and the right to information with copyright.

Final exam
The condition for awarding the assessment is the preparation of a seminar paper on a topic consulted and approved by the teacher and its presentation at the seminar. The topic of the seminar paper is chosen by the student within the scope of the subject syllabus. The seminar paper is usually 5 to 10 standard pages long. The provisions of the internal regulation valid at UPJŠ, which concerns the basic requirements of final theses in the current version, will be applied appropriately to the formal arrangement of the seminar paper, including the requirement to comply with the citation standard. The description of document citations will be accepted if it is implemented according to the ISO 690 and ISO 690-2 standards.
In the seminar paper, the fulfillment of formal and content requirements is evaluated as follows: structure of the paper and methods of scientific work used (maximum 2 points), demonstration of theoretical knowledge of the topic being processed and the student's creative contribution (maximum 2 points), work with literature, case law and other information sources (maximum 2 points), compliance with basic standards for the formal arrangement of the paper, compliance with citation standards, graphic and aesthetic arrangement of the paper, language aspect (maximum 2 points). Presentation of the paper, discussion and answers to questions maximum 12 points. The maximum number of points for the subject is 20, with the grading scale as follows: obtaining 10 points or less is FX, obtaining 11-12 points is E, obtaining 13-14 points is D, obtaining 15-16 points is C, obtaining 17-18 points is B, obtaining 19-20 points is A.
Method of finalization of the subject: preparation of a seminar paper on a topic consulted and approved by the teacher and its presentation at the seminar, presentation of the main conclusions, discussion and answers to questions.
